These Terms of Service ("Terms") govern your use of the EktaCore mobile application, website, and related services ("Service"). By using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Nature of the Service and Non-Reliance

EktaCore is an experimental analytical software tool designed to inspect face photographs for optical indicators of synthetic media generation. The Service evaluates physical and optical properties of images and returns probabilistic indicators alongside calibrated confidence scores.

        Important: EktaCore provides probabilistic analysis for research and preliminary triage only. Results do not constitute legal proof, judicial evidence, or definitive factual findings. Detection models can produce false positives and false negatives. You agree not to rely on EktaCore results for legal proceedings, employment decisions, criminal allegations, financial transactions, or public accusations.
    

2. Disclaimer of Warranties ("As Is")

The Service is provided strictly "as is" and "as available" without warranties of any kind, whether express, implied, statutory, or otherwise. To the maximum extent permitted by law, the developer and operators disclaim all warranties, including merchantability, fitness for a particular purpose, non-infringement, and accuracy.

We do not warrant that:

Analysis results will be accurate, complete, reliable, or error-free.
Synthetic or AI-generated media will always be detected (false negatives can occur).
Authentic media will never be flagged as suspicious (false positives can occur).
The Service will be uninterrupted, timely, secure, or bug-free.

Verdicts such as "Likely Authentic" or "Suspicious" are algorithmic classifications, not factual statements. Confidence scores represent algorithmic calibration, not an absolute guarantee of origin.

3. Acceptable Use and Restrictions

You agree to use EktaCore solely for lawful purposes. You agree that you will not:

Use analysis results to accuse, harass, defame, or blackmail any individual.
Submit images without proper authorization or consent where required by law.
Reverse engineer, decompile, or extract the underlying model weights, heuristics, or architecture.
Use automated scripts, bots, or scrapers to access the Service at scale without an explicit API license agreement.
Resell, redistribute, or white-label EktaCore outputs without prior written consent.
Submit images depicting minors or unlawful content.

4. Usage Limits

Free tiers provide limited scans per day. We reserve the right to modify limits, throttle usage, or suspend access at any time without notice.

5. Intellectual Property

All algorithms, models, optical pipelines, trade secrets, and software code are the exclusive intellectual property of the developer. You are granted a limited, revocable, non-exclusive license to view analysis results for personal or internal evaluation.

6. Privacy and Data Handling

Image processing is ephemeral and handled entirely in volatile memory. Images are never stored, never used to train public models, and never matched against biometric databases. Refer to our Privacy Policy for details.

7. Total Limitation of Liability

To the maximum extent permitted under applicable law:

No liability for indirect or consequential damages: The individual developer, contributors, and operators of EktaCore shall not be liable for any indirect, incidental, special, punitive, or consequential damages, including loss of profits, loss of reputation, legal fees, or employment harm.
No liability for user decisions: You bear sole responsibility for any decision, action, or communication resulting from your use of the Service.
Liability cap: The maximum cumulative liability of the developer and operators for any and all claims related to the Service is strictly capped at the total amount you paid to use the Service in the twelve months preceding the event, or zero euros (EUR 0.00) if you used the Service free of charge.

8. Indemnification

You agree to defend, indemnify, and hold harmless the individual developer, maintainers, and operators of EktaCore from and against any third-party claims, liabilities, damages, losses, or legal expenses (including reasonable legal fees) arising from your use of the Service, your violation of these Terms, or your public statements or decisions based on Service outputs.

9. Disclaimers Regarding Third-Party Content

EktaCore does not control the images you submit for analysis. We make no representations about the legality, ownership, or appropriateness of user-submitted content. You are solely responsible for ensuring you have the legal right to analyze any image you submit.

10. Modifications

We may update these Terms at any time. The "Last updated" date at the top reflects the current version. Continued use of the Service after changes constitutes acceptance.

11. Governing Law and Jurisdiction

These Terms are governed by the laws of Norway, without regard to conflict of law principles. Any dispute arising under these Terms shall be subject to the jurisdiction of the district courts of Oslo, Norway, except where mandatory consumer protection regulations provide otherwise.

12. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.
