Terms of Service — EktaCore

These Terms of Service ("Terms") govern your use of the EktaCore mobile application and related services ("Service"). By using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. What EktaCore Does

EktaCore is a forensic analysis tool that examines face photographs for signs of AI generation. The Service analyzes physical and optical properties of images and returns a forensic assessment with a confidence score and human-readable explanations.

2. No Guarantee of Accuracy

The Service is provided "as is" and "as available." We do not warrant that:

• The analysis results will be accurate, complete, or error-free.
• All AI-generated images will be correctly identified ("false negatives" may occur).
• All real images will be correctly classified as authentic ("false positives" may occur).
• The Service will be uninterrupted, secure, or free of bugs.

Verdicts such as "Likely Authentic," "Suspicious," and "Uncertain" represent probabilistic assessments, not factual determinations. The confidence percentage reflects the engine's statistical confidence in its assessment, not a probability that the image is real or fake.

3. Acceptable Use

You agree to use EktaCore only for lawful purposes. You must not:

• Use the Service to harass, defame, or discriminate against individuals.
• Submit images you do not have the right to analyze (e.g., images obtained without consent).
• Attempt to reverse-engineer, decompile, or extract the detection algorithms.
• Use automated scripts, bots, or scraping tools to access the Service at scale without an API agreement.
• Resell or redistribute EktaCore's analysis results as your own service without written permission.
• Submit images depicting minors.

4. Free Tier & Usage Limits

The free tier of EktaCore provides a limited number of scans per day (currently 5). This limit resets daily. We reserve the right to change the number of free scans, introduce paid tiers, or modify pricing at any time with reasonable notice.

Bonus scans earned through feedback or promotional activities are granted at our discretion and may expire at the end of the calendar day.

5. Intellectual Property

All detection algorithms, physics-based models, sensor logic, threshold values, and proprietary methods used by EktaCore are the exclusive intellectual property of EktaCore and its developer. The forensic analysis pipeline, including but not limited to the SparsePhysicsDetector architecture and sensor implementations, constitutes trade secrets protected under applicable law.

You may share your own analysis results (e.g., screenshots of forensic cards) for personal, editorial, or educational purposes.

6. Privacy

Your privacy is governed by our Privacy Policy. In summary: images are processed entirely in memory, never stored, and never shared. We do not perform facial recognition. See the full Privacy Policy for details.

7. Limitation of Liability

To the maximum extent permitted by applicable law:

• EktaCore shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the Service.
• EktaCore shall not be liable for any decisions you make based on the Service's output, including but not limited to decisions related to employment, relationships, financial transactions, or legal proceedings.
• EktaCore's total liability for any claim arising from the Service shall not exceed the amount you have paid for the Service in the 12 months preceding the claim (which may be zero for free-tier users).

8. Indemnification

You agree to indemnify and hold harmless EktaCore and its developer from any claims, damages, losses, or expenses arising from:

• Your use of the Service in violation of these Terms.
• Your reliance on the Service's output to make decisions about third parties.
• Your violation of any applicable law or regulation.

9. Disclaimers Regarding Third-Party Content

EktaCore does not control the images you submit for analysis. We make no representations about the legality, ownership, or appropriateness of user-submitted content. You are solely responsible for ensuring you have the right to analyze any image you submit.

10. Modifications

We may update these Terms at any time. The "Last updated" date at the top will reflect the current version. Material changes will be communicated through the App or our website. Continued use of the Service after changes constitutes acceptance.

11. Governing Law

These Terms are governed by the laws of Norway. Any disputes arising from these Terms or the Service shall be resolved in the courts of Norway, unless mandatory consumer protection laws in your jurisdiction provide otherwise.

12. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.
